Nursing home rape case still on hold

The daughter of an elderly patient who was allegedly raped by a male nurse at a Kingsbridge nursing home vows to continue fighting for justice for her 64-year-old mother — despite the court’s recent decision to postpone the case for the sixth time. 

“I want to make sure that this doesn’t happen to anyone else,” said a determined Loida Rivera, the victim’s daughter, who explained that her mother has global aphasia and dementia. “I am outraged about what happened to my mother.  Every time I go to court, I have the hope that justice will be served.”

But supporters said that justice has yet to come in the case involving Nanic Aidasani, the 42-year-old male nurse who is accused of raping Ms. Rivera’s mother at the Manhattanville Rehabilitation & Health Care Center at 311 West 231st St. on Feb. 18.

“I went in hoping that this time, the judge was going to be able to have some sort of judgment where I was going to feel some sort of relief, but it was all the contrary,” said Ms. Rivera, 34, whose family is also filing a civil lawsuit against the local nursing home.

Among the other hitches prior to the November hearing, Mr. Aidasani, who is currently free on $20,000 bail, was a no-show for a court appearance in August. He reportedly was treated at the Jersey City Medical Center for an unspecified medical issue. 

At the Nov. 19 hearing at Bronx Criminal Court, the case was adjourned so that the Bronx District Attorney’s office could continue its investigation. 

Mr. Aidasani’s lawyer, Alberto Ebanks of Ebanks & Sattler, LLP, also requested more time for a psychological evaluation of the Yonkers resident. 

Mr. Ebanks did not return calls for comment about his decision to request a psychological evaluation.

Ms. Rivera, however, said she was disappointed that the judge granted Mr. Ebanks’ request for a psychological evaluation.
