Blue Bay Restaurant persistant violator of DEP noise levels

I am writing this letter to make the community aware of the inconsideration and persistent violation by the Blue Bay Restaurant on Johnson Avenue of the Noise Ordinances. Their rooftop ventilation system is so loud that I cannot enjoy peace and quiet in my own apartment. I have called the DEP and filed complaints regarding the decibel level of this screeching noise that comes from their rooftop ventilation at all hours of the night and throughout the day. They have been issued violations by the DEP and nothing is done by the owners to correct this problem. It goes on all day - stops at 11 pm and gets turned back on at 3 am, everyday. I have called the restaurant to put them on notice of the situation only to be told by a manager named Spiros that "nothing can be done and that the only resolution would be for me to move". I cannot express more wholeheartedly how antiquated their system is. I feel that they are breaking the law in more than one way and they feel they are justified in their behavior by contributing to noise pollution and disrespect for the law. Why is it that all the other restaurants on Johnson Avenue who have rooftop ventilation systems run quietly without any noise? My quality of life has been diminished due to lack of sleep and quiet enjoyment. I am physically ill due to the lack of sleep and headaches from the constant vibration, humming and screeching from Blue Bay's antiquated ventilation system. Why can't they just spend the money to fix this system instead of coming up to the roof and tinkering with it and trying to fix it themselves. I know they are a staple in the neighborhood but at whose expense should they continue to be persistent noise violators. I am asking Blue Bay Restaurant to STOP THE NOISE.
